Most employers discover their HR policies are weak at the worst possible moment: during a dispute, an inspection, or a termination that turns into a claim. By then it is no longer paperwork. Under the UAE’s Federal Decree-Law No. 33 of 2021, as amended in 2024, the limitation period for labour claims was extended from one year to two, and penalties now reach AED 1,000,000. A vague clause is risk sitting quietly on your balance sheet.
Here is the reframe experienced HR directors make: your handbook and contracts are the evidence file you hope never to need, and will be very glad to have. In practice, if it is not documented, it did not happen.
Employment Contracts as Risk Control, Not Paperwork
Documented performance management, recorded warnings and clear disciplinary trails cannot easily be disputed before MoHRE. Clear, current contracts shrink disputes over notice, duties, pay and termination, precisely the points where disagreements become claims. The cost of writing these documents properly is trivial next to defending a position you never put in writing.
UAE Employment Contract Rules Employers Must Get Right
Fixed-Term Contracts and MoHRE Registration
Since February 2022, unlimited contracts are abolished: every private-sector relationship must be a fixed-term, MoHRE-registered contract stating salary, job title, working hours, leave, probation and notice. The 2024 amendments also allow salary in currencies other than AED when agreed in writing, and your contract terms must match your WPS records, which is where contracts meet payroll compliance every month.
Probation, Notice and Termination Clauses
Probation is capped at six months with 14 days’ notice to end employment during it. Minimum notice is 30 days both ways; contracts may set 30 to 90 days, but periods stretching far beyond 90 risk challenge as unreasonable. These clauses are tested at the exact moment a relationship ends badly, which is why they fail loudest.
The HR Policies Every Gulf Employer Needs in Writing
A compliant contract is the foundation; policies are the structure on top. At minimum: a code of conduct and anti-discrimination policy (the law prohibits discrimination on gender, race, religion, origin and disability); anti-harassment and grievance procedures, strengthened by the 2026 reforms; disciplinary and termination procedures including lawful grounds for dismissal without notice; a leave policy covering annual, sick, maternity and the 5-day parental entitlement; working-hours and flexible-work policies, now that part-time and job-sharing are formally recognised; and data protection. Each one is the documented ground a manager stands on when a hard decision is challenged.
The Consistency Trap: Contracts, WPS and Reality Must Match
One failure mode deserves its own warning because it catches even well-run companies: inconsistency between documents. If the contract says AED 15,000, WPS shows AED 14,000 with a side allowance, and the offer letter says something else again, every one of those documents becomes evidence against you in a dispute. Regulators and courts read the gap, not your explanation of it. Before drafting anything new, reconcile what your contracts promise with what your payroll actually pays; that single audit resolves more latent claims than any clause you could add.
What Non-Compliant Contracts and Policies Cost in 2026
False recruitment information: AED 20,000 to 100,000. Illegal employment: AED 50,000 to 200,000. General violations: up to AED 1,000,000, doubled for repeats. And enforcement has teeth: MoHRE now issues binding decisions on claims up to AED 50,000 with the force of a court writ, and can order wages paid while a dispute runs. Weak documentation turns a defensible position into an expensive one.
